Prefazione
Wikipedia, l’enciclopedia virtuale più consultata su Internet, afferma che il Parco Nazionale del Cilento e del Vallo di Diano è nato dalla necessità di tutelare il Cilento dalle speculazioni edilizie e da un distruttivo turismo di massa.
Con l’istituzione del Parco, oltre 13 anni fa, non sono diminuite the speculation nor contain the environmental degradation.
Far from it!
The park is rich in protected areas on paper, what are the Special Protection Areas (SPAs) and Sites of Community Importance (SIC) identified with appropriate directives (Directives 79/409 EEC Birds "and 92/43" Habitat ").
The park has received other international awards and high.
It is recognized by UNESCO as a "Biosphere Reserve" (June 1997).
In 1998, then, has been recognized as "World Heritage", to be transmitted intact to future generations.
The landscape and environmental awards out there, as we see.
Protected Areas, SCI, SPA areas, very stringent laws. We tend

However, things, of course, not as they should!
There has been systematic violations of the laws that should protect the natural and cultural qualities that form the basis of the status of Park and international awards.
These violations have been repeatedly denounced by the Codacons with all the legal instruments that the law provides. There were then exposed, warnings, complaints, complaint to the prosecuting authorities of the Republic. It still appeals the TAR, repeated exposure to the Superintendence for Cultural Heritage and Landscape and the Park.

La cementificazione della costa sta assumendo connotati sempre più preoccupanti.
I Comuni concedono concessioni a costruire in modo invasivo, anche a pochi metri dal mare, talvolta addirittura con rimozione di sabbia e di massi naturali.
In tal modo diventa spesso difficile comprendere l’effettività del ruolo di controllo, di supervisione e di tutela paesaggistica che la Legge concede ad Enti quali il PNCVD e la Soprintendenza ai Beni Culturali e per il Paesaggio.
Pisciotta. The Port

In località Lacco nel Comune di Pisciotta, a pochi metri dal mare, la Cooperativa Sea Village intende realizzare circa 40 villini (!), una struttura produttiva turistica
In verità un massiccio e pesante intervento urbanistico in prossimità della costa e del mare!!
La Cooperativa richiedeva allo Sportello Unico Attività Produttive Cilento to activate the procedures for variant planning. The City of
Pisciotta (correctly) opposed the variation to the one-stop shop Cilento declaring non-compliance of the intervention to the existing urban planning instrument falling since intervention in Zone E4 (agricultural land preservation, geologically unstable) which does not provide production assistance tourist same as those proposed by the Cooperative. Codacons in 2008 has taken the battle to protect the Bay Trentova.

Codacons, in January 2009 appealed to the Administrative Tribunal of Salerno to get access to the records.
Marina di Camerota.
Oltre 30 concessioni agli stabilimenti balneari: uno degli ultimi lembi di spiaggia con dune marittime nelle mani del turismo di massa.
Il Codacons Campania, nell’ottobre 2008 ha presentato alla Commissione Europea una denuncia per apertura di Procedura di Infrazione contro lo Stato italiano per violazione delle norme comunitarie che proteggono le aree S.I.C..
La vicenda riguarda le note dune marittime presenti – un tempo – sul litorale di Marina di Camerota.
Il Parco Nazionale del Cilento e del Vallo di Diano elaborava un Piano di Gestione del S.I.C. (IT8050041) denominato “Scoglio del Mingardo e spiaggia di Cala del Cefalo” in ottemperanza del LIFE Nature project "management of the network of SCI and SPA in the Park."
The final draft of the Park, accompanied by General Report, Impact Assessment and Plans, is in fact contradictory, inconsistent and incomplete.
In summary: the project does not allow adequate protection of the Site of Community Importance, indeed the very prejudice. The Plan recognizes and could not be otherwise, that "Cala del Cefalo southern Italy represents one of the last stretches of dune vegetation colonized by psammofila characterized by plant species typical of sandy soils, in grave danger of extinction, mainly due to footfall of passing vehicles on dunes. So
Plan, in its guidelines provide, at least on paper, a control of the concessions in the stretch of dunes and coastal stressing that the resulting man-made (also) by increasing concessions to the dune beach resorts in the area results in a safe environmental damage. There is much talk about the injurious increase in accommodation (camp sites and tourist villages) and bathing facilities (dining facilities) to the detriment of the dune vegetation on the different bands and integrity of natural environments at the foot of the cliffs.
The Plan also notes that excessive human presence, due to more extensive accommodations, hurts the entire habitat, with damage also to the species of birds (gulls and herring gull) that usually nest on rocky cliffs found there. These concerns are repeated, emphatic with apprehension, even in the section on SWOT analysis.

Monte San Giacomo.
Il Comune di Monte San Giacomo approntava la costruzione di una strada – avente la portata di un’autostrada ! - Monte San Giacomo, 1200 meters above sea level, particularly in the area of \u200b\u200benvironmental and landscape value and deviations from original plans.

Protection of watercourses.
River Calore. The Consortium for Velia
Basin Reclamation dell'Alento had an original idea (!?!), even enlightening.
In July, 2008 (Act No. 1086 with Prot), the Consortium presented the Park a Preliminary Technical Data Sheet on "The interconnectedness of water scheme Sele - Alento" (Proposal for sustainable integrated development of Cilento and the Central Valley Sele).
A huge project as unnecessary and harmful.

How did it go? The Consortium
shelve the project!
Bussento River.
Bussento River flows almost entirely within the National Park and insists its course in the protected area (zone 1) and falls into the category of interesting places SCI. The river height of boxes in Pittari flows in a karst sinkhole where it disappears, giving rise to an underground river, and then come together again at the outside of Morigerati e poi sfociare a mare, dando vita ad un fenomeno carsico di particolare pregio e rilevanza ambientale. L’ultimo corso del fiume Bussento è ritenuto area S.I.C. (IT8050007 "Basso corso del fiume Bussento").
Tale patrimonio idrico è messo a repentaglio dal progetto che riguarda proprio l’ultimo tratto del fiume Bussento ove è previsto un intervento (Centro Canoe e strutture varie quali 3 corpi di fabbrica in ferro, vetro e legno, a due piani, con uffici, sala polifunzionale, spogliatoi, depositi, bar, mansarda praticabile ecc.) fortemente invasivo finanziato (anche) mediante POR, misura 1.9..
Inoltre, nella stessa area, o in prossimità della medesima, la Società Snam ha presentato un progetto di gasdotto che partendo da Manforte S.Giorgio in Sicilia, con tragitto sottomarino, giungerebbe alla foce del Bussento e con un tragitto in superficie costeggerebbe, e/o attraverserebbe, il fiume per un tratto di 3 km.
Tali interventi determinano, e in parte hanno già determinato, danni ambientali e paesaggistici, segnatamente alla vegetazione ripariale dove trovano rifugio e cibo uccelli migratori.
Il Codacons Campania, con atto inoltrato verso la fine dell’anno 2008, invitava l’Ente Parco e la Regione ad adottare tutte le possibili misure di protezione del sito e chiedeva alla Regione se sussistente la Valutazione di Impatto Ambientale sul progetto relativo al Centro Canoe.
La Regione Campania rimaneva inerte e non rispondeva when the Association.

Land Protection: Actions against illegal building.

The phenomenon is extremely undervalued - or even nothing warned - by the people and institutions that tolerate it enough to not apply in most cases, law enforcement and repression which are also foreseen by the law.
It may seem paradoxical, but the Cilento was more intact before it became a protected area. In 2005 were found by police in the provincial command of Salerno 100 cases of abuse in the Park building.
As an example of deep degradation and questionable management of public affairs can not fail to report below on what has become a real case, the "IF MONTECORICE" raised forcefully by Codacons in tutte le sedi con puntuali diffide legali presentate al Comune, alla Soprintendenza, all’Ente Parco, al Prefetto, al Ministero dell’Ambiente. A queste diffide hanno fatto seguito anche azioni di carattere giudiziario.
Cosa fa l’Ente Parco contro il diffuso abusivismo edilizio?
Niente, verrebbe subito da dire.
Quasi niente, diciamo ricorrendo a formule più diplomatiche!
Il “caso Montecorice” è in questo Dossier dettagliamene descritto. Esso, come si vedrà, è l’emblema dell’inerzia culturale, dell’inefficienza amministrativa, della poca attenzione verso la legalità e il rispetto delle regole.

The Park Board did not respond to requests for access.
Codacons Campania predisposed to see and use Administrative Court recognized the right of access and therefore the transparency of administration.
The eco - monsters
Montecorice. In
Montecorice, the hill overlooking the prized Loc Case del Conte, near the Red Ripe, there are, in a dominant position, a number of illegal articles.
The demolition orders are outstanding for over 20 years! Outside
gobbledygook, ordinances di demolizione non sono eseguite da oltre VENTICINQUE ANNI!
Un complesso residenziale -non completato- composto di numerosi scheletri di cemento che arrecano all’ambiente un notevolissimo pregiudizio e determinano un sicuro degrado paesaggistico tanto da essere giustamente definiti “eco-mostri”.
“Eco-mostri” che il proprietario ha strenuamente difeso in sede penale, civile e amministrativa perdendo tutte le battaglie giudiziarie stanti le conclamanti illegalità.
Più di vent’anni non sono bastati alle Autorità competenti (Comune, Ente Parco, Prefetto, Procura della Repubblica) a procedere agli abbattimenti così come previsto dalla Legge.
È questa una storia molto “italiana” that deserves to be told in detail.
Amongst them, the various stages:
-1 - Codacons filed for access to environmental Montecorice asking for documentation of the artifacts in question.

Furthermore, the Prefect, with Note 7-Jan-08, following a new request in writing by the Codacons, informed that the 11-Oct-07 were summoned to the Prefecture, the Mayor and representatives of the Superintendent of Salerno and the Park . In that meeting the Mayor of Montecorice undertook to speed up the process for the demolition of illegal articles.
After many months nothing has changed!
Articles of cement are still there, intact.
-4 - Codacons, then, presented new instance of access to environmental Montecorice to verify any action taken by the body.
The City did not respond to entry. Il Codacons, nel gennaio 2008, ha presentato ricorso al Tar di Salerno.
-5- Il Codacons, viste le incomprensibili inerzie ed omissioni, investiva della questione il Presidente della Repubblica.
-6- Nel luglio del 2008 il Comune di Montecorice finalmente rigettava l’istanza di condono edilizio e successivamente adottava Ordinanza di abbattimento degli Eco – mostri.
-7- Il proprietario dei manufatti di cemento avverso tali atti presentava Ricorso straordinario al Presidente della Repubblica e impugnativa innanzi al Tribunale Amministrativo di Salerno.
Il Codacons interverrà in dette procedure per sostenere le ragioni del Comune.
L’ultimo paradosso: gli Eco-mostri generati con i fondi P.O.R.
Il Codacons Campania assume iniziativa per comprendere il meccanismo di gestione dei finanziamenti comunitari nell’area del Parco Nazionale.
A titolo esemplificativo, l’attenzione si concentra su DUE progetti che hanno usufruito del finanziamento P.O.R..
È l’Ente Parco ad avere un ruolo centrale nella gestione dei P.O.R., denominati P.I.T., non cambia però la sostanza: si tratta sempre di finanziamenti europei. Cooperano con l’Ente Parco nella gestione dei cospicui finanziamenti comunitari gli altri enti locali.
Veniamo ai DUE progetti; a seguito di accesso agli atti l’Associazione ottiene i documenti sul “Museo del fiume e dell’area faunistica della Lontra” nel Comune di Aquara e il International Center for the Study of Migration - Calchas-project called "The Myths" - in the town of Centola.

Tre i risultati conseguiti con (molti de)i P.O.R.:

Il Codacons Campania ha presentato denuncia alla Corte dei Conti nazionale e comunitaria.
I nuovi POR 2007/2013
L’Associazione, visti gli sprechi che hanno caratterizzato la precedente gestione dei fondi europei, chiedeva all’Ente Parco di conoscere il programma e quindi le opere da finanziare nel territorio del Parco con fondi POR / PIT.
Il Ministero dell’Ambiente, investito per conoscenza dell’istanza del Codacons, interveniva dichiarando che il diritto alla trasparenza e alla divulgazione cede di fronte ad altre esigenze di salvaguardia di altri interessi protetti dalla normativa speciale.
L’Ente Parco non rispondeva alla richiesta di accesso.
Il Codacons Campania predisponeva Ricorso al Tribunale Amministrativo per vedere riconosciuto il diritto di accesso e quindi la trasparenza dell’attività amministrativa.
Conclusions The strong deterioration of situations highlighted by this study represent a minimal fragment of the many sufferings undergone by the environmental and landscape heritage that has a value to be received so valuable areas international recognition by UNESCO.
Neglect reached peaks of such gravity that together with the inertia of the institutions and bodies and gentlemen activity control keeps alive the question that gave the title to 2007 Dossier: Cilento, is worthy of being called Nature Park?
The question is affirmative if we concentrates on the natural beauty that are resistant to the human hand and a questionable management of resources.
More difficult is the answer if we evaluate the administrative and strategic choices. However Codacons
intention to submit the question to the attention of the public and representatives of institutions of good will. First of all those working within the European Union Commission, the investigating authorities, the Prefecture, the Ministry of Environment, the new President of the Park, the Superintendence for Cultural Heritage and Landscape, the Master's Porto. Bodies over natural target of complaints, complaints, of lawsuits, injunctions and prosecutions of Codacons.
The application can not fail to invest the representatives of UNESCO, Section for Italy, so that they do-responsibly-appropriate thoughts on whether the conditions that led to the recognition of the environmental status already assigned to the Cilento.
